1. Definitions
1.1 The “hirer” means the person/s, organisation or company booking the equipment, act or entertainment with the “Company”.
1.2 The Company means Funny As Duck
2. Food & Drink
2.1 Food or drink, of any kind, entering the Booth is strictly forbidden. This includes hot and cold food, alcohol, soft drinks, hot drinks, water and any other beverage. The Company reserves the right to end all Services early, without refund, in the interests of Company Staff safety, in the instance of breach of this condition.
2.2 The Hirer assumes all responsibility for all equipment once it is installed at the Venue Location.
2.3 Company Vehicles and/or equipment damaged by the Hirer or the Guests will be charged to the Hirer at replacement cost.
3. Space and Electrical Supply
3.1 A flat, clear and safe surface must be provided by the Hirer and/or the Venue. A minimum area of 3 metres width by 3 metres depth by 3 metres height is required to facilitate correct & safe set up and installation of the Equipment. It is the Hirer's responsibility to ensure that there is sufficient and safe power available at the Event Location. We require a minimum of 1 x 13 amp socket with 13 amps spare capacity. Electrical supply sockets must be within 10 metres of the Equipment location.
4. Delivery and Arrival
4.1 The Company cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure. In the case that we cannot attend or fulfil your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability shall be limited to a refund of any monies paid in relation to the contracted event. No further compensation will be paid irrespective of any loss of earnings.
4.2 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded unless previously agreed.
4.3 In the event that we are not ready to commence at the agreed time due to our fault, then we will still give you the agreed hire period by extending the finishing time of the hire. In the event that the hire does not start at the agreed time, as setup has been delayed due to any unforeseen circumstances that are no fault of The Company, then the hire will still end as per the agreed time on booking form. In the event that we have set up in time but the hire does not start at the agreed time due to over running of previous activities by you or venue, the hire will still end as per the agreed time on booking form.
5. Equipment Installation
5.1 All Equipment hired will be suitably and safely installed by a member of staff. The Company reserves the right to withdraw the use of certain Equipment if at the time, it is deemed unsafe to use such Equipment.
6. Equipment Operation
6.1 Only Company Staff may operate the Company's equipment. Under no circumstances may unauthorised personnel tamper, move or attempt to use equipment owned by the Company. The Company also cannot accept any responsibility for damage caused to the Venue Location, or injury to caused to the Hirer, the Guests and/or the Venue Staff caused directly by third party unauthorised intervention.
7. Complaints
7.1 In the event of a complaint, the Hirer should attempt to rectify the problem with the Company's staff on the Event date at the Venue Location. Where this is deemed not possible complaints should then be made in writing to the Company or by email to: funnyasduckphotobooths@gmail.com within 28 calendar days of the Event Date. Complaints will be fully investigated and a response made available to the Hirer within 10 calendar days.
8. Cancellation Charges
8.1 The Hirer may cancel the Booking Agreement at any time by doing so in writing to the Company or by email to: funnyasduckphotobooths@gmail.com. The Booking Deposit is non-returnable. Cancellations made within 2 weeks or less of event day incur a cancellation cost of 50% of the balance due.
9. Balance Due
9.1 The Balance Due Amount is due 28 calendar days before the event date. We do not accept any method of payment on the night. Hire Services will not be supplied to the Hirer if the Balance Due Amount has not been paid in full.
9.2 Booking Agreements that do not have the Balance Due Amount paid and cleared 7 calendar days prior to the Event Date will be deemed cancelled by the Company and will incur Cancellation Charges. In this instance the Company reserves the right not to attend the Venue Location on the Event Date and not to supply the Hirer with any services.
10. Additional Fees
10.1 To change the Event Date of a Booking Agreement - £20
11. Site Location, Facilities and Conduct
11.1 It is the Hirer's responsibility to ensure all Equipment booked is suitable for use at the Venue Location. No refunds, in part or full, will be given for non-use of Equipment that cannot be used due to any Venue restrictions imposed. Not all Equipment is designed to fit through narrow doorways and/or up staircases. It is the Hirer's responsibility to inform the Company of any access restrictions that may impede set up or Venue rules/regulations that may restrict or completely prevent specific equipment use. Hire Start Times may be significantly delayed if the Venue Location is not on ground floor level and the Company has not been informed of this fact, by either the Hirer or the Venue, prior to the Event Date.
11.2 The Hirer is responsible for obtaining permission at your venue to use the photo booth
11.3 The Hirer is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.
11.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or Hirers conduct endangers the safety of the guests, Hirers, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.
11.5 We also reserve the right to refuse guests admission into the photo booth if we feel they are too unruly.
11.6 In any instances where we feel there is a need to terminate the hire we will always speak with the host first to try to resolve the matter before terminating. If we do have to terminate the hire due to reasons stated above, the full cost of hire is still payable and we will not issue any refunds for hire time that has been cut short.
11.7 The Hirer is held fully responsible for their and their Guest's behaviour. Company staff will not entertain abusive Hirers and/or guests, and will cease to operate the booth during instances of threatening behaviour. The Company reserves the right to end all Services early, without prior notice or refund, in the interests of Company Staff safety.
11.8 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
12. Booking
12.1 A £50 non-refundable deposit is required at the time of booking a photo booth, the remaining balance is due 28 days prior to your event.
12.2 Your booking is not confirmed until you receive a booking confirmation letter or email from us.
